Director, 2 more indicted in fatal Ga. train crash

SAVANNAH, Ga. (AP) -- The director of a movie about singer Gregg Allman and two other executives on the project were indicted Thursday on felony charges stemming from a fatal crash in which a freight train plowed into the film's crew in southeast Georgia.

A grand jury in rural Wayne County returned charges of involuntary manslaughter and criminal trespassing against "Midnight Rider" director Randall Miller as well as his wife and business partner, Jody Savin, and the film's executive producer, Jay Sedrish.

If they are convicted, the filmmakers each could face up to 11 years in prison for the Feb. 20 death of Sarah Jones. The 27-year-old camera assistant from Atlanta was killed and six other crew members were struck by a train while shooting footage on a railroad bridge spanning the Altamaha River southwest of Savannah. . . .

SAVANNAH, Ga. (AP) - A production company formed to make a biographical film about singer Gregg Allman was cited by federal regulators Thursday for workplace safety violations stemming from a train crash in rural Georgia that killed a camera assistant and injured six others.

The Occupational Safety and Health Administration proposed $74,900 in fines against Film Allman LLC, a company incorporated in 2013 to make the movie "Midnight Rider." The company was cited for two safety violations saying it willfully put workers in danger of being struck by a live train and put them at risk of falling off a railroad bridge where they were shooting a scene.

Filming had just begun on "Midnight Rider" when a freight train plowed into the crew Feb. 20 on a railroad trestle . . .

CSX: Film Crew Denied Track Access Before Crash

SAVANNAH, Ga. — CSX Transportation twice denied producers of a biographical movie about singer Gregg Allman permission to shoot on its railroad tracks before a freight train slammed into the film's crew in south Georgia, killing one worker and injuring six, the company said in court documents.

Legal filings in Chatham County State Court mark the first time Florida-based railroad operator CSX has made any publicly available statement about the Feb. 20 crash involving one of its trains and the crew of the movie "Midnight Rider." Lawsuits have been filed against CSX and the film's producers by the parents of Sarah Jones, a camera assistant killed in the collision, and two injured crew members. Director Randall Miller and two other top executives on the production have also been indicted on criminal charges.

CSX sues producers of 'Midnight Rider'

Legal troubles mounted for the producers of "Midnight Rider" this week as railroad company CSX Transportation sued the filmmakers, claiming that they illegally filmed on its tracks where a train collided with the crew earlier this year..

CSX said in a countersuit that the producers trespassed on its property before a freight train crashed into the crew as they were filming a scene for the Gregg Allman biopic on a historic train trestle near Jesup, Ga.

New, surprising details have emerged about the on-set death of 27-year-old camerawoman Sarah Jones during the first day of filming on Midnight Rider. Crew members were not told about an email from railroad owner CSX denying them permission to shoot on the Doctortown train trestle in rural Georgia, as at least 20 members piled onto the tracks 25 to 30 feet above the water under dangerous conditions led by director Randall Miller.

Reporter: After the hideous accident on the trestle bridge above the altamaha river in rural Georgia, there was a silence as scary as what had come before. At first it was like a quiet, like people were in shock at what happened. I remember hearing somebody say "Oh my gosh, she's dead.

Reporter: Ever since the accident on February 20th, investigators have been trying to figure out who wasn't doing their job to keep this crew safe. The people who made poor choices that day need to be held fully accountable. Reporter: Investigators would uncover this e-mail, sent to location manager charley Baxter on the morning of the shoot in which the railroad refuses to grant the film permission to shoot on its tracks.

‘Midnight Rider': Wrongful Death Defendant Claims Video “Manipulated” On ’20/20′

 

Two weeks after shocking footage from the train that killed Midnight Rider camera assistant Sarah Jones was revealed on the Oct. 31 episode of ABC’s 20/20, railroad company CSX is hitting back against the Jones family lawyers. In a motion filed this week in the ongoing wrongful death case against CSX and over a dozen other defendants (read it here), CSX accused Jones’ lawyers of slipping the train footage to ABC News and asked a Georgia court to block any further evidence from going public pre-trial.

The company claims that after the Jones lawyers received the CSX-owned train footage from a discovery request, they violated terms of their licensing agreement.

LOS ANGELES — The family of Sarah Jones, a crew worker who was killed by a freight train this year on the set of the independent film “Midnight Rider,” reached a settlement with 11 defendants in a civil suit over her death, a lawyer for the family said.
