Resident files suit seeking restrictions on train horns in Helena
Noise from trains is one aspect of living in Helena that many residents seem to dislike, and one Helena man is so fed up with blaring horns that he has filed a federal lawsuit in an attempt to limit their use.
Stephen Kelly filed the suit in U.S. District Court in Helena in July against Burlington Northern Santa Fe Inc., Montana Rail Link Inc. and the companies’ presidents. He alleges that the use of train horns is excessive and violates Helena’s noise ordinance and the federal Noise Control Act regulated by the Environmental Protection Agency.
Kelly wants the court to restrict train horns to one use upon approaching a street crossing and silence them after 10 p.m.
