BNSF news release, 11/14:

Update on Derailment at Casselton, North Dakota

FORT WORTH, Texas, Nov. 14, 2014:

Last night at about 5:30 p.m., an eastbound train carrying lumber and paper products derailed 21 cars that subsequently struck a passing westbound train derailing 12 empty tank cars. We have been working through the night to clear the area and anticipate reopening both tracks late tonight. The underlying cause of the derailment appears to be a broken rail. We are working with the Federal Railroad Administration to learn what factors led to the break. The track was visually inspected earlier yesterday with no issues and has been regularly inspected in accord with our track inspection program, which complies with federal standards. We are grateful that there were no injuries. As we continue working to understand what occurred in this incident, we will also undertake a broad-based review of the infrastructure in this vicinity to assure the residents of Casselton of its integrity.

The delegation, which has been pressing BNSF officials to take timely and substantive measures to mitigate the likelihood of accidents in the region, welcomed the railroad’s actions.

“We have been in regular contact with BNSF Executive Chairman Matt Rose, as well as other railroad officials to press them to promptly and effectively improve safety not only on this section of track, but on all track in the state,” Hoeven and Heitkamp said. “The company’s specific steps announced to reduce the risk of accidents in the future is welcome news.”

Engineer in fiery Casselton oil train crash sues BNSF Railway

FARGO – The engineer of an oil tanker train that exploded after derailing near Casselton in 2013 is suing the railroad, claiming its negligence caused the fiery wreck that has left him with post-traumatic stress disorder.

Bryan Thompson of Fargo was operating the oil tanker train when an oncoming grain train derailed in his path just west of Casselton on Dec. 30, 2013, according to the lawsuit filed Tuesday in Cass County District Court.

Thompson couldn’t stop the oil tanker train in time. It hit the grain train and then itself derailed.

Sued by engineer of train that exploded, BNSF says it may be shielded by federal law

FARGO — BNSF Railway, owner of an oil tanker train that derailed near Casselton and exploded in 2013, says that federal law may shield it from a civil lawsuit filed last month by the train's engineer.

Any injuries suffered by the engineer, Bryan Thompson of Fargo, "are the result of unknown causes for which BNSF is not responsible," the rail giant said in an answer to Thompson's complaint.

AP via Fort Worth (TX) Business Press, 4/28:

BNSF employee interviews released following N.D. derailment

Federal investigators have released hundreds of pages of records that offer new insight into the moments just before and after a 2013 oil train derailment near Casselton, North Dakota, that created a massive fire and forced 1,400 people to evacuate for several days.

Interviews with workers of Fort Worth-based BNSF Railway operating the two trains in the derailment are included in documents the National Transportation Safety Board posted online Monday. Federal investigators also said in the documents that a broken train axle found after the derailment might have been prevented if BNSF railroad had inspected it more carefully and found a pre-existing flaw.

The broken axel wasn't pinpointed as the cause of the crash, but the NTSB ordered the industry to recall 43 axles made by Standard Steel in the same 2002 batch.
