Judge O.K.'s pretrial merger of CSX lawsuits, CSX asks cases be thrown out

 

 

KNOXVILLE — Three federal lawsuits filed against CSX Transportation Inc. over a train derailment and chemical fire in Maryville can be joined into a single case, though CSX is still trying to get the litigation thrown out of court.

 

In a Friday hearing in Knoxville’s U.S. District Court, U.S. Magistrate Judge Clifford Shirley O.K.’d a merger of the cases for pretrial fact-finding purposes.

 

CSX is facing three federal lawsuits in the July 2 derailment of a train car in the area of Mt. Tabor and Old Mt. Tabor roads. The car was carrying a toxic chemical called acrylonitrile, which caught fire and began leaking into the ground as heavy smoke and toxic fumes traveled the air. The incident forced the evacuation of about 5,000 residents from a two-mile radius.

But at Thursday’s hearing, mechanical engineer James Whelan told U.S. Magistrate Judge C. Clifford Shirley Jr. the roller bearing on the derailed tank car was well past its useful life, and should have been replaced.

CSX pays out more than $430K to local agencies for July train derailment in Blount County

 

MARYVILLE, Tennessee — CSX Transportation has paid over $431,000 to local agencies since a train carrying hazardous material derailed and caught fire in eastern Tennessee earlier this year.

CSX has also paid more than $3.5 million to residents and others immediately affected by the fire.

Two more lawsuits filed against CSX nearly one year after derailment


As the filing deadline approaches for lawsuits related to the 2015 Maryville train derailment, two more families have come forward with claims against CSX.

On Friday, Atlanta-based attorney Robert Underwood filed two lawsuits in Blount County Circuit Court.


This is the latest.

CSX continues groundwater cleanup two years after spill

Two years after the July 2, 2015, train derailment in Maryville, CSX Transportation Inc. continues efforts to remove a toxic chemical from groundwater in the immediate area.

 

To reduce concentrations of acrylonitrile, a chemical used to make plastics and other synthetic materials, a company working for CSX is pumping additional chemicals into injection wells.

 

“Results indicated that there was on average an 87 percent reduction in contamination in the treated wells,” Eric Ward, communications director for the the Tennessee Department of Environment and Conservation, wrote in an email response to questions last week. “CSX is now taking steps to expand this technology to treat the entire spill area.”

KNOXVILLE — A federal judge will decide whether two expert witnesses can testify at trial after hearing the pair criticize CSX Transportation Inc. and Union Tank Car Co. over a train derailment and chemical fire in Maryville two years ago.

 

The two men, one a mechanical engineer, the other a former track manager and derailment investigator in the railroad industry, were in Knoxville’s U.S. District Court Thursday to testify on behalf of several Blount County residents suing CSX and Union Tank Car (UTC) over the July 2, 2015, derailment.
