Resident files suit seeking restrictions on train horns in Helena

 

Noise from trains is one aspect of living in Helena that many residents seem to dislike, and one Helena man is so fed up with blaring horns that he has filed a federal lawsuit in an attempt to limit their use.

 

Stephen Kelly filed the suit in U.S. District Court in Helena in July against Burlington Northern Santa Fe Inc., Montana Rail Link Inc. and the companies’ presidents. He alleges that the use of train horns is excessive and violates Helena’s noise ordinance and the federal Noise Control Act regulated by the Environmental Protection Agency.

 

Kelly wants the court to restrict train horns to one use upon approaching a street crossing and silence them after 10 p.m.

City wants to silence horns from freight trains in Helena

 

The familiar sound of locomotive horns as trains pass through Helena could become part of the city’s history by early 2016.

 

City commissioners indicated support for reducing the projected cost to implement a “quiet zone” at railroad crossings in Helena by eliminating two of the six from consideration: the Montana Rail Link crossings at National Avenue and Roberts Street.

 

The commission’s direction will allow its consultant, KLJ, to design the needed safety measures for the remaining four railroad crossings and also initiate the process with the Federal Railroad Administration for creating a quiet zone.

Silencing train horns in Helena might cost more than expected

 

The city of Helena’s plan to silence the horns of trains passing through town may have to include two railroad crossings that had been omitted.

 

Montana Rail Link and the Montana Department of Transportation want safety measures installed at all six of the city's railroad crossings before supporting the creation of a “quiet zone” that would eliminate the need for train horns at crossings.

 

Additional safety measures such as the installation of curbing and horns that satisfy federal requirements can allow a city to create a quiet zone. 

 

Safety measures were proposed for four of the crossings in Helena but not for those at National Avenue and Roberts Street.
