B.C. Supreme Court sides with CP in battle over Arbutus corridor

 

Canadian Pacific Railway Ltd. was within its rights to bulldoze some sheds and smash through community gardens along its unused Arbutus corridor, a judge has ruled, and the company can forge ahead with plans to store railcars on the abandoned line.

 

“The City did not and cannot claim any property interest in the Arbutus corridor, nor can the City assert such rights on behalf of others in response to the proposed use of the corridor” by CP, Chief Justice Christopher Hinkson of B.C. Supreme Court wrote in his judgment released Tuesday.

 

He dismissed the City of Vancouver’s application that sought to prevent CP from resuming its clearing work along the line that hasn’t been used to transport freight for more than 13 years.

CP train cars returning to Arbutus corridor tracks

 

 Canadian Pacific has revealed plans to bring rail cars back into the Arbutus corridor for the first time since 2001.

 

The railway company sent letters to Vancouver residents living along the corridor alerting them that it’s ready to restart operations on its land.

 

“We will commence transporting and storing rail cars on the tracks in the coming weeks. We ask for your cooperation in staying off the railway corridor for safety reasons,” reads the letter, which was signed by CP government affairs director Mike LoVecchio.

Vancouver wants Arbutus rail corridor sold at a discounted price

 

The City of Vancouver has fired another salvo in its long-running dispute with Canadian Pacific Railway Ltd., applying for an order that would force the company to put its Arbutus corridor up for sale at a reduced price.

 

The city announced Wednesday it has filed an application with the Canadian Transportation Agency, an independent tribunal that resolves transportation disputes. The city has asked the agency for an order that would require CP to sell the corridor at its net salvage value, as well as an order that would nullify CP’s plan to reactivate the track.

Arbutus Corridor: Vancouver tries new tactic in battle with CP

City application argues CP violated federal law by not selling the land at salvage value

 

The City of Vancouver is trying another tactic in its battle with Canadian Pacific over the railway company's plan to start running trains again along the Arbutus Corridor.

 

The city is asking the Canadian Transportation Agency to order CP to halt its plans because CP breached the Canadian Transportation Act when it abandoned rail operations in 2001 and didn't offer to sell the land back to the government at net salvage value.

 

The city also wants the federal agency to force the company to sell the rail line back to the city at the 2004 salvage value.

It’s been fairly well publicized, especially after we tore out your community gardens, some of which have been in place long enough for fruit-bearing trees to actually bear fruit. CP and City of Vancouver agree to sale of Arbutus Corridor
March 7, 2016 | Calgary, AB

​​Canadian Pacific Railway Limited (TSX: CP) (NYSE: CP) and the City of Vancouver today jointly announced that they have agreed to terms for the sale by CP of the Arbutus Corridor to the City for $55 million.

 

"For many years now, CP has been involved in conversations with the City about the future of the Arbutus corridor," said Keith Creel, CP's President and Chief Operating Officer. "We are pleased that today's landmark agreement allows the City to create a transportation corridor and greenway while providing a fair return to CP and our shareholders."

 

The agreement also allows CP to share in future proceeds on the eventual development and/or sale of certain parcels of the corridor.

"CP has been an important part of Vancouver for 130 years, and while balancing the needs of industry against the desires of municipalities is not always easy, today's agreement demonstrates that by working productively together we can accomplish great things to the benefit of all," said Mr. Creel.
