Circuit Court Judge says Portage County Can't Enforce Stopped Train Ordinance
Portage County Circuit Judge says the Sheriff's Office doesn't have the ability to ticket railroads when their trains stop and block crossings for more than 10 minutes.
Previously, the Portage County Sheriff's Office issued citations of up to $200 when trains stopped and blocked crossings across the county.
Sheriff Mike Lukas explains that while the trains do pass through Portage County, railroads are subject to federal regulations rather than those at the state or local level. It is the reason that the judge ruled that the county can't enforce it's ordinance against the stopped trains.
